The Changes clause of a construction contract gives the project owner the right to alter the scope of work, while making equitable adjustments to the contract price and schedule. The Changes clause also gives rise to the concept of a “constructive change;” an owner directive which, although not labeled as such, alters the contract requirements. But does the Changes clause require an owner to issue a change order when changed market conditions impose higher performance costs on a contractor? That question was recently presented to a Utah court.


 

The International Code Council (ICC) will develop a Guideline for Building Commissioning for facilitating increased efficiency in commercial buildings. A committee of global industry leaders and technical experts will be appointed to develop the guideline. Commissioning is a new process required by the International Green Construction Code (IGCC), CalGreen, and Leadership in Energy and Environmental Design (LEED) certification.

“Commissioning, or the verification of how a building performs once the certificate of occupancy is issued, is the only way to ensure the design and performance of the building is being maintained and therefore reducing emissions,” ICC Chief Executive Officer Richard Weiland said.


 

Bentley Systems Inc. and Tekla Corp. have formed a joint collaboration to further advance the interoperability of software within building information modeling (BIM) workflows. The companies are improving interoperability between the Tekla Structures BIM software and Bentley’s Integrated Structural Modeling (ISM) methodology.

Once ISM-linked, Tekla Structures will interoperate with all other ISM-enabled software including Bentley’s STAAD, RAM Concept, RAM Elements, Structural Modeler, ProSteel, and ProConcrete. Tekla Structures links with various other systems through the Tekla Open API application Tekla Open API application programming interface that is implemented using Microsoft .NET technology.
